RE:Public domain for Image:Seal Bangkok.png?[edit]

Since I found the Official Seal Law B.E. 2482 (พระราชบัญญัติเครื่องหมายราชการ พุทธศักราช 2482 - use this keyword to seek it in http://www.ratchakitcha.soc.go.th/) in Royal Thai Government Gazette, I think for this problem for a long time. If you think for the public domain of the seal of Bangkok, we should talk about other thai provincial seals because all of them the uploaders indentified them in public domain too. Would you mind if we talk for it in Thai wikipedia? My english is not quite well.

Commons:Deletion requests/Thai provincial seals[edit]

I am ready to close this debate and delete the images from the Commons, since they are no longer in the public domain. However you requested assistance in moving the images to Wikipedias that use them, and that allow non-free images. Does the Thai Wikipedia allow non-free images? Image copyright on the Thai Wikipedia is a somewhat sticky issue I try not to get involved in, but basically non-free images are allowed. The th:แม่แบบ:ชอบธรรม template is the broadest tag for such images.
The Check-Usage tool (accessible from the top of any image page on Commons) allows one to check what wikis an image is being used in. I was hoping that appropriate tools or bots may be available to help ease the process, but if you're up to uploading them manually, please do so; thank you. --Paul_012 (talk) 19:09, 8 January 2008 (UTC)[reply]
According to the 2007 Wikimedia Foundation licensing resolution, no Wikimedia project may use non-free images unless they are doing so under an "exemption doctrine policy" (EDP). I don't believe the Thai Wikipedia has implemented an EDP. Regardless, there are no tools available that I know of. I moved the images to the English Wikipedia manually, but I'm not willing to do so for any other projects without proof of an EDP allowing them. ครับ ภาพขนาดใหญ่มักไม่เป็นปัญหาอะไรครับ เพราะ MediaWiki จะย่อภาพให้โดยอัตโนมัติเวลาใช้งาน ส่วนวันที่ถ้าไม่มีบันทึกวันถ่ายไว้ ก็น่าจะใช้วันอัพโหลดแทนได้ครับ (อาจจะวงเล็บบอกไว้ว่าเป็น upload date) ที่จริงไม่ทราบรายละเอียดเหมือนกัน แต่เข้าใจว่าการให้ข้อมูลวันถ่ายจะเป็นประโยชน์มากกว่า --Paul_012 (talk) 15:52, 31 August 2008 (UTC)[reply]

ถ้าไฟล์เป็นฟอร์แมตเดียวกันก็อัพโหลดทับไฟล์เดิมได้เลยครับ ที่วิกิพีเดียภาษาต่าง ๆ จะอัพเดทตามอัตโนมัติ ส่วนถ้าเป็น png แล้วอัพโหลดใหม่เป็น jpg ให้ใช้แม่แบบ

Help with a picture from the Thai wikipedia[edit]

Hi Paul, I've seen that you're a native speaker of Thai and therefore maybe you can help me. I'd like to upload to commons the following picture: th:ภาพ:Surayut.JPG. Unfortunately, I can't read Thai so that I cannot find our the source of the picture neither its licensing information (as far as I've been able to understand, it is claimed to be in the public domain, but without a proper source, its impossible to assert that. It's being claimed to fall under Article 7 of the Thai Copyright Act, but I find that objectionable because the source is an official website, which should not fall under "Regulations, by-laws, notifications, orders, explanations and official correspondence of the Ministries, Departments or any other government or local units". --Paul_012 (talk) 12:40, 1 September 2008 (UTC)[reply]

Southern Thailand map[edit]

On the map of Thailand,http://en.wikipedia.org/wiki/Southern_Thailand, most of the provinces in the South are incorrectly labelled. No1 , for example, should be Chumphon, not Nakhon Sri Thammarat. Number 8 is Phuket, not Chumphon. fyi.

Prolific Thai user doesn't seem to understand wikimedia categories[edit]

Hi there Paul_012. User Donavanik is creating a huge amount of categories pertaining to Buddhism in Thailand. Some of these categories are very badly or incorrectly categorised, and some others have very imprecise names (for instance Category:World Peace). Thanks, Jcb. I wasn't aware that {{source missing}} is not to be used with obviously PD images. (Probably the template documentation should mention the fact.) I didn't think removing false source info from image pages and correctly tagging them as missing counted as "unnecessary" either, as I was hoping to prompt the uploader to provide correct info instead. ผมเห็นว่าในเมื่อเวลานี้ประชาชนทั่วไปสามารถเข้าชมพระเมรุมาศ และมีภาพถ่ายพระเมรุมาศที่เป็นภาพเสรีอัพโหลดเข้าสู่ระบบของวิกิมีเดียคอมมอนส์แล้ว ผมเห็นว่าควรจะลบภาพพระเมรุมาศที่แคปเจอร์มาจากไฟล์วีดีโอข่าวของ TNN24 ซึ่งคุณได้อัพโหลดไว้ก่อนหน้านี้ทั้งหมดเสียดีกว่าครับ เพราะภาพถ่ายชุดนั้นย่อมเป็นของตัวสถานีโทรทัศน์ ไม่น่าจะเข้าเงื่อนไขภาพเสรีที่สามารถใช้งานในวิกิมีเดียคอมมอนส์ได้

Date formatting[edit]

Hello.

Can you update File:Date format by country.svg and File:Date.svg by copying from the most updated File:Date format by country (new).png which itself was updated by using the latest sources in Date format by country, so they are up to date and also in sync with the PNG file?

Unfortunately I don't know how to edit SVG maps myself, that is why I asked you.

สวัสดีครับ ผมคือผู้ใช้กสิณธร ราชโอรส ซึ่งได้ถูกลบภาพออกไปหลายภาพโดยมีคนบอกว่าไปก็อปปี้ภาพออกมาจากเว็บอื่น ผมจึงอยากจะขอชี้แจงว่า

ผมถ่ายรูปโบราณสถานมาตั้งแต่ ปี 2011 เพื่ออัพโหลดขึ้นเฟซบุ๊คส่วนตัว ตั้งแต่ตอนนั้นถึงประมาณกลางปี 2013 เมื่อผมอัพขึ้นเฟซแล้วก็จะลบภาพต้นฉบับทิ้ง ทำให้ไม่เหลือภาพต้นฉบับ

ต่อมาช่วงปี 2013 ผมเริ่มอัพโหลดภาพขึ้น panoramio โดยนำภาพวัด สถานที่ โบราณสถานทั้งหมดที่ถ่ายตั้งแต่ปี 2011 มาอัพ ซึ่งภาพที่ถ่ายตั้งแต่ปี 2011 ถึงกลางปี 2013 เป็นภาพที่ดาวน์โหลดออกมาจากเฟซบุ๊ค ทำให้ข้อมูลวันเวลาที่ถ่ายภาพ หายไปหมด แต่ตั้งแต่ช่วงครึ่งปีหลังของปี 2013 ภาพที่อัพขึ้น panoramio จะเป็นภาพต้นฉบับจากกล้องที่มีวันเวลาที่ถ่ายครบทุกอย่าง และตอนนี้ภาพต้นฉบับทุกภาพที่ถ่ายตั้งแต่ครึ่งหลังของปี 2013 ยังอยู่ครบ สามารถตรวจสอบได้

I have been take photos since 2011-2013 for upload on my own facebook and when I upload on facebook , I will delete the original photos.

In 2013, I have upload the Temple & Historic site photos to panoramio (I take photos in 2011-middle of 2013 by myself). Almost of photos that upload to panoramio, I download from my own facebook, it make the date, time vanished and have small size.

However, after middle of 2013, Photos that upload to Panoramio have date, time and description because it’s original photos and you can examine if you want.

The contest of love monuments 2014, I sent all of picture to contest (including picture of 2011-middle of 2013) and my own facebook have all those photos, you can check if you want.

Thanks for the message, EugeneZelenko. Some of those typeface specimens were necessarily in PNG due to the simple fact that I don't have those fonts, and had to print-screen them from existing examples. Others I purposely uploaded in a raster format to avoid possible copyright issues. The status of vector images of fonts seem quite unclear. I've seen some discussions where it's been claimed (questionably, IMO) that any image of text is always PD, regardless of creativity. On the other hand, Template:PD-font says that only raster renderings of fonts are PD in the US, and vector images may be subject to copyright. The law doesn't define what constitutes "ตั้งเปิดเผยประจำอยู่ในที่สาธารณะ", so it's open to interpretation. Private properties that are generally open to the public sort of fall in a grey area, and Wikimedia Commons policy generally prefers erring on the side of caution. Shopping mall is definitely a public place, it is not grey area. Most places are owned by some entities, government or private person. If street, public park, or university owned by government could be public place, then private properties like shopping mall, privately owned opened park, or private university could also be public place. The term public place does not depend on who own the place, whether government or non-government. The term en:privately owned public space could confirm that private properties could be public space.

I don't think we need to hurry. The author doesn't seem to have a problem with the image being used on Wikipedia, but asked for time to discuss this further with the uploader. Revaluating Thai emblems?[edit]

Hello, I recently think about the application of exceptions of copyright per Thai Copyright Act BE 2537, and came across many emblems which were uploaded to Commons from governmental sources (most notably, the Royal Gazette). I agree some re-evaluation is probably need. The problem is our understanding of the law is still quite limited, and Thai IP law isn't an area with much available resources for guidance. Deletion discussions on Commons are sparsely attended nowadays. ประเด็นสถานะลิขสิทธิ์ของเครื่องหมายราชการไทยยังกำกวมอยู่พอควรครับ เพราะ พรบ.ลิขสิทธิ์มีกำหนดทั้งตามมาตรา 7 ว่ากฎหมาย (และระเบียบ ข้อบังคับ ฯลฯ ของหน่วยงานของรัฐ) ไม่เป็นงานอันมีลิขสิทธิ์ และมาตรา 14 ว่าหน่วยงานของรัฐมีลิขสิทธิ์ในงานที่ได้สร้างสรรค์ขึ้นในความควบคุมของตน ซึ่งอาจตีความขัดแย้งกันได้ ที่ผ่านมา เครื่องหมายราชการต่าง ๆ ที่อัปโหลดขึ้นคอมมอนส์ใช้เหตุผลว่า

  1. เป็นผลงานของสมเด็จฯ กรมพระยานริศรานุวัดติวงศ์ ซึ่งสิ้นพระชนม์มาเกิน 50 ปี จึงหมดอายุการคุ้มครองลิขสิทธิ์ไปแล้ว และ/หรือ
  2. เป็นส่วนหนึ่งของกฎหมาย เพราะปรากฎอยู่ในประกาศสำนักนายกรัฐมนตรีเรื่องกำหนดภาพเครื่องหมายราชการหรือกฎหมายอื่น ๆ ตีพิมพ์ในราชกิจจานุเบกษา จึงไม่มีลิขสิทธิ์ หรือ

แต่ทั้งสามเหตุผลก็มีปัญหา เพราะ (1) สิ้นพระชนม์ครบ 50 ปีในปี 1997 ซึ่งเลย URAA restoration date จึงอาจยังมีลิขสิทธิ์ในสหรัฐฯ (ดู Commons:URAA-restored copyrights ซึ่งก็ยังมีข้อขัดแย้งและลักลั่นในทางปฏิบัติอยู่มาก) ส่วน (2) และ (3) ก็ไม่ชัดเจนว่าเอกสารแนบท้ายกฎหมาย หรือหัวกระดาษ นับเป็นส่วนของกฎหมาย/ระเบียบ ข้อบังคับ ฯลฯ นั้นหรือเปล่า (และก็เคยมีกรณีโลโก้พรรคการเมือง ซึ่งถูกลบจากคอมมอนส์เพราะเป็นภาพที่มีลิขสิทธิ์อยู่ก่อน ถึงจะลงในราชกิจจาฯ ก็ไม่ควรสูญเสียสถานะทางลิขสิทธิ์)

แต่ทั้งนี้ในทางปฏิบัติเหตุผลตาม (1) กับ (2) ก็ยังพอกล้อมแกล้มครับ เพราะสามารถระบุที่มาได้ชัดเจน และเคยยอมรับกันใน Deletion request บนคอมมอนส์มาแล้ว ส่วน (3) ผมไม่คุ้นว่ามีเคสที่เคยอ้างโดยตรง ปัญหาหลักคือสองเหตุผลนี้น่าจะไม่ครอบคลุมภาพที่ดัดแปลงต่อยอดเพิ่มเติมจากต้นฉบับเดิม (เช่นลงสี เขียนใหม่ในคอมพิวเตอร์ ฯลฯ) การอัปโหลดไฟล์อย่าง File:Seal of the Ministry of Public Health of Thailand.svg จึงไม่น่าจะถูกต้องตามสองเหตุผลข้างต้นนัก นอกจากจะมองว่าการดัดแปลงนั้นไม่มีความสร้างสรรค์มากพอที่จะมีลิขสิทธิ์นอกเหนือจากภาพต้นฉบับ หรือยึดเหตุผลตาม (3)

กลับไปที่คำถามตั้งต้นของคุณ Oum ผมว่าต้องดูเป็นราย ๆ ไปครับว่าสถานะลิขสิทธิ์ของภาพต้นฉบับเป็นยังไง และที่สำคัญคือต้องอธิบายเหตุผลไว้ในคำอธิบายไฟล์ด้วย อย่างภาพเครื่องหมาย กทพ.กับ รฟม. ผมเพิ่งได้ไปดูเพิ่มเติมถึงเห็นว่ามีระบุในเอกสารแนบท้ายกฎกระทรวง อันนี้น่าจะให้เหตุผลตาม (2) ได้ ยังไงผมจะระบุข้อมูลเพิ่มเติมและถอนการแจ้งลบนะครับ ส่วนกรณีอื่นก็อาจใช้ {{PD-Thailand}} กับ {{PD-TH-exempt}} กับ (1) และ (2) ตามลำดับ (ควรแนบลิงก์ต้นฉบับกฎหมายหรืออธิบายเหตุผลเป็นข้อความด้วย) และในกรณีที่ดัดแปลงภาพ ก็อาจระบุ {{CC-BY-SA-4.0}} (ถ้าต้องการเครดิต) หรือ {{PD-self}} (ถ้าอยากให้เป็นสาธารณสมบัติ) ในฐานะเจ้าของลิขสิทธิ์ส่วนที่ดัดแปลงได้ครับ
